Historic halachic responsum about a desecrated sheet from a Torah scroll found in a German dump upon which a German priest had written, "Hashem's word will persevere forever." New York, 1969. To the best of our knowledge, this responsum has never been printed.


The responsum is addressed to Rabbi Noach Avraham HaKohen Oppenheimer. It deals with a Torah scroll that was desecrated by the Nazis, may their names be obliterated. One sheet of it was desecrated and found in a German dump. A German priest had written on it the chilling passuk, "Hashem's word will persevere forever." The posek hador covers the relevant halachic concerns one by one in this letter of responsum:


  • Is each person who sees this desecrated sheet required to perform kriyah as required for anyone who sees a disgraced Torah scroll?
  • Where is the best place to put this sheet - in a synagogue genizah or in a graveyard?
  • Perhaps it is best to frame it under glass and put it up on a synagogue wall as an eternal memorial?
  • What should be done about the chilling line on it written by the priest?

Rabbi Moshe Feinstein, known as posek hador, considers not only the dry halachic considerations in his historic ruling, but also the feeling that will be evoked in the Holocaust survivors who pray at the synagogue.
